Stark Surplus Return and Warranty Terms and Conditions

Items sold by Stark Surplus may not be covered by the original manufacturer’s warranty because Stark Surplus is not an authorized dealer of any items sold. However, Stark Surplus provides a 30-day non-warranty return policy on all items, as well as a thirty-day warranty on used items, and one-year warranty on all new items.

All Stark Surplus’s warranties and returns are non-transferable without Stark Surplus’s prior written consent.  Stark Surplus's warranties shall only be applicable to Goods stored, installed, handled, operated, or otherwise used under normal conditions. Stark Surplus's obligation shall be limited to the repair or replacement, in Stark Surplus’s sole discretion, of any such Good (or part/component thereof as Stark Surplus determines) free of charge to the customer. If Stark Surplus determines that the Good cannot be repaired or replaced, Stark Surplus shall credit the customer’s account in an amount equal to the sum the customer paid for it. This warranty is given in lieu of any other warranties, either express or implied, including that Stark Surplus disclaims any warranty of merchantability, fitness for a particular purpose and/or non-infringement. In no event shall Stark Surplus be liable for any damages except actual damages up to, but not exceeding, the amount customer paid to Stark Surplus for the particular Good. Further, Stark Surplus shall not be liable for any special damages including consequential damages, incidental damages, lost profits, or lost revenue.

Non-Warranty Returns

Non-warranty returns are accepted within thirty (30) calendar days from the order date. Customers will be responsible for all return shipping charges. All returned items must be in their original condition, including any original packaging. Sealed products must be returned in the same condition. A 25% restocking fee will be applied to all non-warranty returns.

Standard Used Warranty Return Policy (30 Days)

This warranty applies to all used goods sold by Stark Surplus.

Stark Surplus warrants that all used sold goods shall be free from functional defects for a period of thirty (30) calendar days from the order date (“Warranty Period”).

If, during the Warranty Period, a customer wishes to make a claim (“Warranty Claim”), the customer must provide notice using the following channels:

Upon receipt of a Warranty Claim, Stark Surplus will issue a Return Authorization Number (“RMA”). Stark Surplus will not accept any Warranty Claim without a valid RMA.

Freight and rush fees for goods returned under Warranty Claims remain the responsibility of the customer. 

Warranty Claims must be received before the end of the Warranty Period, along with the return of the product within the same period.

 

Standard New Warranty Return Policy (90 Days)

This warranty applies to all new goods sold by Stark Surplus.

Stark Surplus warrants that all sold goods shall be free from functional defects for a period of ninety (90) calendar days from the order date (“Warranty Period”).

If, during the Warranty Period, a customer wishes to make a claim (“Warranty Claim”), the customer must provide notice using the following channels:
